Voicetal, LLC, dba TweetMic.com and TweetMic (“TweetMic”) is committed to your privacy. This Privacy Policy (“Policy”) relates to information concerning all products, services, web pages and websites offered or provided by TweetMic or any of our subsidiaries or affiliated companies. Our Policy includes obeying all laws and regulations in the United States that relate to any use or disclosure by us of information we obtain from you. Unless an exception is noted in this Policy, we will not trade, sell, or disclose to any third party any personally identifiable information, or “PII” (as defined below), without your consent and we will not disclose or make available any PII to any third parties seeking to market non-TweetMic products without your consent. This Policy explains how we collect and use information (1) from customers who purchase TweetMic services and products (“Customers”) and (2) from visitors to our websites and from potential customers who have communicated or interacted with TweetMic (“Visitors”). This Policy applies to both the offering of TweetMic products and TweetMic online and offline services.

Collection of Information

TweetMic will receive and store audio files and text associated with such files submitted by our Customers. Although we will not purposely disclose such files to third parties, except as necessary to provide the TweetMic services described on our websites, you should not expect that the information you submit to us will remain confidential. The purpose of the TweetMic website and the services provided by TweetMic is to assist you to broadcast your audio files and texts through twitter.com and other similar services. Accordingly, we do not, and you should not, view the content of the audio files and texts you submit to us to be confidential. Similarly, we cannot control the use or disclosure of the audio files and texts submitted by our Customers once we have transmitted them to twitter.com or other third-parties.

TweetMic may collect personally identifiable information, including but not limited to name, telephone number, mailing address, e-mail address, credit card or other payment information and other personal information (collectively, “PII”), from Customers in connection with the sale or marketing of TweetMic products and services. TweetMic may collect PII from Visitors in connection with any visit to our websites, any communication about our products and services or other transactions or communications with TweetMic. Once TweetMic has processed the applicable payments for a Customer, all credit card and other payment information for that Customer is purged from our system and is no longer stored, transmitted or used in any way by TweetMic.

TweetMic may also collect information that is not personally identifiable regarding usage of our services or our website (“Non-PII”) from Customers and Visitors. Non-PII may include website pages viewed, time spent using certain services, demographic data, cookies and other information which does not specifically identify any one individual.

Cookies

“Cookies” are small files containing strings of characters that many websites place on your computer in order to facilitate and enhance your interaction with that website. We may use cookies to customize your use of our websites and for other purposes to make your visit more convenient or to enable us to enhance our service.

You can configure your web browser to stop or restrict the placement of cookies on your computer or to delete them from your computer. If you stop the placement on or delete TweetMic cookies from your computer you may still use our website, but some of its functionality may be limited.

TweetMic and our advertisers may use clear gifs, web beacons and third party cookies to improve website performance, provide certain features such as advertising or to track usage anonymously of our websites and track the online activity of users. We may also use such devices in HTML-based e-mails to track their usage similar to how we track usage of our websites.

Spyware

“Spyware” means any executable software application that is installed on a user’s computer that covertly gathers and transmits PII over the Internet without the consent of the user. We do not consider cookies and web beacons to be Spyware. Spyware may gather PII, such as credit card or other payment information or e-mail addresses, or may alter the user’s computer settings. We believe that Spyware threatens a computer user’s privacy and the ability to securely communicate or conduct transactions online. Therefore, our internal policies and procedures forbid any TweetMic employee, agent, partner, affiliate or contractor from intentionally deploying or using Spyware on behalf of TweetMic. Any such deployment or use will not be tolerated and will be grounds for dismissal, contract termination and/or other forfeiture.

Use of Information

We will transmit the audio files and texts submitted by our Customers to us to twitter.com and other third parties, to be distributed according to any arrangement such Customers have with such third parties.

Unless an exception is noted in this Policy, TweetMic will use PII only (1) to market products and services to Customers and Visitors, (2) to provide products and services requested by Customers and Visitors, (3) to allow our vendors and service providers to assist TweetMic in the marketing and provision of such products and services to Customers or Visitors, and (4) to provide third parties TweetMic believes to be reputable with information for marketing purposes. We will not, however, provide credit card or other payment information to any third party unless it is involved in processing payments for products or services that a Customer has purchased from TweetMic. TweetMic only works with third parties that we believe maintain high standards with respect to protecting privacy and consumer rights.

TweetMic may also use or disclose PII to investigate and help prevent potentially unlawful or fraudulent activities that threaten the integrity of our service, to investigate fraud or violations of our Terms and Conditions, as required by courts or administrative agencies, or in connection with a sale, merger or reorganization of TweetMic’s business.

TweetMic may use Non-PII as described in this Policy, and may disclose Non-PII to third parties.

Security

TweetMic has invested in a variety of security features to make reasonable efforts to protect the privacy of information on our website. In addition, TweetMic has implemented internal procedures to ensure Customer and Visitor privacy is safeguarded throughout our organization. TweetMic will implement appropriate new policies and acquire appropriate additional security features as new technologies become reasonably available. However, no system can give a 100% guaranty of security, especially a service that relies upon the public Internet. Therefore, you acknowledge the risk that third parties may gain unauthorized access to your information when using our website.

Privacy of Communications

TweetMic will not listen to, view or disclose to any third parties any audio files, images, graphics, or other files or information or other communications that Customers or Visitors transmit to TweetMic except as required to ensure proper operation of our websites and to allow us to provide our products and services as contemplated by our websites, or as otherwise authorized by law.

Privacy Policy Concerning Minors

TweetMic does not provide products or services for purchase by minors. TweetMic does not knowingly solicit or collect PII from persons under the age of eighteen.

Third Party Websites and Services

Our websites may contain links to other websites and services not affiliated with or controlled by TweetMic. In addition, other websites and services may also reference or link to TweetMic. We encourage you to be aware when you leave our websites, or surf the Internet, and to read the privacy statements of each website that you visit. We do not endorse, screen or approve, and are not responsible for the privacy practices or the content of, such other websites and services.

TweetMic does not assume any liability for the actions of third parties that have been provided with information as permitted by this Policy or that have collected information as permitted by this Policy (such as advertisers using third party cookies).

Opt-out Policy

If you do not want your PII used by TweetMic for any direct marketing purposes, then you may opt-out of such disclosures by calling us at 1-877-850-5262.

However, we are not responsible for removing your PII from the lists of any third party who has previously been provided your information in accordance with this policy. Since TweetMic must use a Customer’s PII in order to provide the Customer with TweetMic products and services, Customers cannot opt-out of all uses of their PII unless they choose not to purchase TweetMic products and services.

Changes to policy

We reserve the right to modify, add, or remove part or all of this Policy at any time by posting such changes here. You should review this policy regularly for changes, and can easily see if changes have been made by checking the Effective Date below. Your continued use of our websites following the posting of any changes to this Policy means you accept such changes.

Terms and Conditions

This Policy is subject to the TweetMic.com Terms and Conditions. Please refer to the Terms and Conditions regarding certain rights and limitations with respect to your use of TweetMic’s websites.

United States of America

Our websites are maintained and provided in the United States of America. By using our websites, you authorize the export of your PII to the USA and its storage and use as specified in this Policy.
